Hi there

I would like to find out more about the term of Importer of Record, is this term related to the Incoterms used.

Currently we are having the incoterm of DDU with a customer, but they have specifically asked us to use their assigned shipper / forwarder as they would like to leverage on the shipping costs by having all suppliers using the assigned shipper.

We are in the process of negotiating to change the terms to FCA, may I know if there is any impact on the term of Importer of record.

In my opinion, the BUYER is always the Importer of record as different countries have different regulations on the control of import, while the SELLER is always the Exporter of record.

Please assist and comment.

The Importer of Record can be either the buyer or the seller of the goods. basically it means whoever is responsible for all the customs charges (duty, tax, other government fees as applicable) If you were using the term DDU, ( Deliver duty unpaid) that means that ultimately the reciever or consignee of the goods were responsible for getting the shipment set up with their customs broker and looking after all the necessary fees. If you had used the term DDP, (Deliver Duty Paid) that means the ultimate consignee IS NOT repsonsible for the customs clearance arrangements and duty/and or tax. does this help!
